USAGE RULES
The Peninsula Bay Community Facility (the Facility) is for the use of Members and their families. The standard of use and behaviour should be consistent with a family focussed environment. The use of bad language, excessive alcohol consumption, and other forms of generally unacceptable/antisocial behaviour will not be tolerated and will result in access being terminated.
Members agree to observe all the rules set out below and as may be further stipulated by Peninsula Bay Community Facility Incorporated (PBCFI) and be responsible for ensuring anyone accessing the Facility using the Member’s access card understands and observes these rules. Any accidents/incidents must be recorded in the Health & Safety Manual provided in the Community Lounge and reported to PBCFI Committee at penbaypool@gmail.com. Facilities and equipment are available for use only at the risk of users and without liability of any kind to PBCFI.
(1) Membership
▪ An application form for usage rights must be completed and accepted by PBCFI.
▪ PBCFI has the right to suspend, waive, alter or amend the terms and conditions of use and usage rules at any time.
▪ PBCFI has the ability to suspend usage rights for any breach of the rules by the Member or any person for whom the Member is responsible.
(2) Access
▪ Access will be by way of electronic swipe card.
▪ Only one swipe card will be issued per residence.
▪ A $20 replacement fee will be charged for lost or damaged swipe cards.
▪ Access is available only to Members and persons residing at the address to which access to the Facility is granted.
▪ Where the Member makes their home available for short term rental accommodation and provides the tenant access to the Facility, the Member is responsible for the behaviour of the tenant and liable for any damage they may cause.
▪ Membership applies to only one residence, i.e. membership cannot be shared with other households.
▪ Swipe cards may only be used by the Member and persons residing at the address to which access to the Facility is granted. Any guests of the Member must be accompanied by the Member at all times.
▪ Guests are regarded as people not listed on the membership application form and staying temporarily with a Member, or staying in their own accommodation but visiting the Member in Wanaka (e.g. on holiday), or attending an event to which they have been invited by a Member (e.g. a children’s party), or occasionally accompanying a Member. Guests do not include Wanaka residents who regularly or repeatedly accompany a Member to the Facility as this is regarded as card sharing. The Member is responsible for ensuring guests are aware of the Usage Rules and is accountable for guests’ behaviour.
▪ Unauthorised access of the Facility is prohibited (this includes out of hours access or access to any area of the Facility internal or external which is in any way restricted on either a temporary or permanent basis).
(3) Subscription
▪ The subscription is currently set at $600 per annum, $400 for six months, and $300 for three months, and is reviewed annually by PBCFI.
▪ Payment for terms of six or three months must be made in full in advance.
▪ Payment for an annual term can be made in full in advance or by monthly automatic payments for a minimum of 12 months with the anniversary date being the date of the first payment.
▪ The Member accepts and agrees to pay the usage charges in advance for the term of their membership.
(4) Hours of operation
▪ The hours of operation where access is available are currently 6am to 10pm daily but may be varied at PBCFI’s discretion. Access outside of these hours will be deemed as trespassing.
▪ Access may be suspended or limited if required for any reasonable purpose and at PBCFI’s discretion. November 2021
(5) General Rules
▪ Show respect for the Facility and other Members.
▪ No dogs permitted within the Facility area.
▪ Smoking and/or vaping is not permitted in any part of the Facility area.
▪ The main access gate must be kept closed after entry and exit and must not be propped open under any circumstances.
▪ Do not climb over the fences or the access gate.
▪ The use of the Facility for any commercial activity must have the permission of PBCFI.
▪ Members are responsible for ensuring spa pool covers are replaced after use, barbeques are cleaned and turned off, the gym is left tidy, all windows and doors to the building and gates are closed and locked, and the Facility is generally secure before leaving.
▪ The changing rooms are provided for that purpose and the gym and community room must not be used as changing rooms.
(6) Pool Rules
▪ Children under 14 years must be accompanied and supervised by an adult.
▪ Members must follow the QLDC pool supervision policy regarding supervision of children under 8 years of age, which is available here https://www.qldc.govt.nz/recreation/swim/our-supervision-policy.
▪ No running around the pool area.
▪ No glassware around the concrete pool area.
▪ No jumping or diving into the pools.
▪ Nappies worn in the pools must be designed for swimming.
(7) Gym Rules
▪ Children under 14 are not permitted to use the gym.
▪ Appropriate footwear and clothing must be worn at all times. Swimwear is not considered suitable gym attire.
▪ Users are responsible for ensuring equipment is clean, tidy and ready for the next user after use.
(8) Property Damage
▪ Please report any maintenance issues or damage to penbaypool@gmail.com.
▪ Members are responsible for the costs arising from any damage they or their guests cause to the premises or equipment.
▪ PBCFI shall not be liable for any loss or damage to user property.
(9) Community Lounge
▪ Booking: A booking system is in place for Members’ functions.
▪ Cleaning: Members are required to clean and tidy the community lounge immediately after their own use and within their booking time so that it is ready for other users. Rubbish bins and recycling bins are outside. Members failing to leave the Facility clean after use may incur cleaning costs.
▪ Wet clothes are not permitted in the community lounge as they create a slip hazard.
